House Mouse, Norway Rat or Something Else
House mouse (Mus musculus). Droppings 3 to 6mm, dark, pointed at both ends. Passes a 6mm gap. Ranges only a few metres from the nest, so mice in an apartment mean a nest inside the building rather than a visitor.
Norway rat (Rattus norvegicus). Droppings 18 to 20mm, blunt ends. Passes a 13mm gap. Burrows, swims, travels sewer lines, ranges 30 to 50 metres or more. Roof rats are effectively absent from this region, so rat control here is a below-ground job.
Deer mouse and white-footed mouse appear on properties backing onto woodland β bicoloured, white underneath, larger eyes and ears β and are seasonal intruders rather than residents.
What is often not a rodent at all: noise in the attic at dawn and dusk is usually grey squirrel, because mice are nocturnal and squirrels keep daylight hours. Heavy slow movement overhead at night is more likely raccoon. Getting this wrong costs weeks.
Grease trails β dark smears where fur oils rub off on a repeatedly used route β show where the animals actually travel, which is where traps belong. Gnaw marks run about 2mm for mice, 4mm for rats.
How They Get In β Two Different Buildings, Two Different Answers
6mm for a mouse, 13mm for a rat. Where those gaps are depends entirely on which kind of building you are in.
In the multi-family stock the routes are internal and vertical. Plumbing and heating risers run cellar to roof in common chases, and in most older buildings the escutcheon plates at each floor are missing, leaving an open gap at every level. Mice travel that and often nest on the top floor where it is warmest. Add connected cellars, party walls, and floor drains whose traps have dried out and opened a path from the sewer.
In detached housing the routes are external and mostly at ground level. The attached garage is the most reliable autumn entry there is β a worn bottom seal, failed corner gaskets, then straight up the common wall. Then utility penetrations at the foundation and rim joist, the sill plate on older houses, crawlspace vents with damaged screening, and roofline gaps a squirrel has usually opened first.
In pre-war frame houses of either kind, balloon-framed walls run uninterrupted from sill plate to attic, so a mouse entering at grade is heard on the top floor and treating where the noise is accomplishes nothing.

Trapping, Exclusion and What Actually Ends It
Exclusion is the only permanent step. Trapping removes what is present; sealing decides whether more arrive. A quote with no exclusion in it is a quote for an ongoing service.
Interior: trapping, not bait. Rodenticide inside an occupied building means animals dying in wall voids nobody can reach, and in a multi-family building the smell then affects apartments that had no problem at all. Interior work is snap and multi-catch traps set against walls, on grease trails, at right angles to the run, in real numbers.
Exterior: bait in tamper-resistant stations placed on active burrows and runs, with burrows collapsed afterwards so reopening is visible evidence.
What is in the bait. Second-generation anticoagulants β brodifacoum, bromadiolone, difethialone, difenacoum β were restricted out of consumer sale by the EPA's rodenticide risk mitigation decision and limited to professional use in tamper-resistant stations, which is why over-the-counter products underperform. Secondary poisoning matters more here than in the city: a rodent carrying those compounds stays toxic to whatever eats it, and this region has hawks, owls, foxes and outdoor cats in numbers. Bromethalin is a neurotoxin, acts faster and has no antidote β worth knowing in a household with a dog.
Materials. Copper mesh, hardware cloth and mortar work. Steel wool rusts and fails; expanding foam alone is chewed through and only works over a metal backing. A garage door needs a genuine seal to the slab and intact corner gaskets, not foam tape.
Who Is Responsible β the New York Rules That Actually Apply Here
Almost everything published about pest control in "New York" is actually about New York City, and very little of it applies here.
What does not apply. HPD has no jurisdiction over your building. A 311 complaint is a New York City service. The indoor allergen hazard law, the annual bed bug disclosure requirement and the designated Rat Mitigation Zones are all New York City local laws. If a contractor or a website tells you to file with HPD, they have not understood where you live.
Applicator licensing. Certification is by the NYSDEC, category 7A for general structural and rodent work. The business holds a registration and the individual holds certification β ask for both numbers.
Your actual legal lever is the warranty of habitability, at Real Property Law section 235-b. It is statewide, cannot be waived by a lease, and obliges a landlord to keep the premises fit for human habitation. A persistent infestation is a habitability condition under it, not a tenant expense.
Enforcement runs through your own municipality. Each city, town and village has a building department and code enforcement officer applying the Property Maintenance Code of New York State, which requires structures to be kept free from insect and rodent infestation and makes the owner responsible. That officer, not an agency in another county, is who inspects.
The county health department β Westchester or Rockland β handles public health nuisance complaints, rabies and wildlife questions, and mosquito surveillance including treatment of standing water on public land at no charge.
In a multi-family building, report in writing to the owner and keep the copy, then escalate to code enforcement. Practically, the building has to be treated as the unit: the population lives in the riser chase and the cellar, so treating one apartment while the neighbours go untreated is money spent on a delay.
Why it matters beyond the nuisance: mouse urinary protein is a recognised indoor allergen and a documented asthma trigger, and in an older building that exposure is continuous. Chewed wiring inside a wall or attic is a real fire risk, and fouled insulation has to be replaced rather than cleaned.

We hear it in the attic but we sealed the attic. Why is it still there?
Because the entry is probably at ground level. In balloon-framed houses the wall cavity runs uninterrupted from the sill plate to the attic, so an animal entering near grade arrives upstairs without crossing a room. The work belongs at the sill and rim joist. If the noise is at dawn and dusk rather than after dark, it is more likely squirrels.
We have a dog. What should we know?

Almost certainly that the neighbouring units are not being treated at the same time. In this housing stock the apartments share plumbing risers and continuous wall voids, so the population lives in the chase between units rather than in any one kitchen, and whichever unit is left untreated acts as a reservoir. What holds is treating the whole line or building on the same day with gel bait and a growth regulator, and sealing the riser penetrations. Ask for that in writing so it is on the record.
Is there anything I can do myself that actually helps?
Two things, and they are worth doing even while you push the landlord. Seal the annular gap around the pipes under your sink and behind the bathroom fixtures with a proper escutcheon plate or sealant β that is the main vertical route into your unit and closing it makes yours the harder apartment to reach. And keep the floor drain trap primed with water if you have one, because a dried trap is an open pipe to the sewer. Do not buy over-the-counter roach sprays: they are repellent, they scatter the population deeper into the shared voids, and they ruin any bait that gets used later.
